Terms of Service
Effective June 3, 2026
These terms govern your use of Setsail, a software product provided by Everfancy LLC. By creating an account, connecting a financial account, purchasing a subscription, or using Setsail, you agree to these terms.
Use Of Setsail
Setsail helps users organize personal finance information, review account activity, categorize transactions, and view budgets and summaries. You are responsible for the information you provide and for keeping your account credentials secure.
You must be at least 18 years old to use Setsail. You may use Setsail only for lawful personal or household purposes.
Your Data
You retain ownership of the content and data you provide to Setsail. You grant Everfancy a limited license to host, process, transmit, display, categorize, and use that content and data only to provide, maintain, secure, support, and improve Setsail.
Setsail is designed so your device remains the source of truth for your personal finance content. Server processing may access that content to perform requested app functions, but Everfancy designs Setsail to minimize persistent server-side copies of detailed financial content. Limited operational records, provider processing records, backups, security records, support records, and encrypted token records may still exist as described in the Privacy Policy.
No Financial Advice Or Money Movement
Setsail is software. It is not a bank, broker, lender, investment adviser, credit repair organization, debt settlement service, money transmitter, or payment initiation service. Setsail does not provide financial, legal, tax, investment, or credit advice. You are responsible for your own financial decisions.
Connected Accounts
If you connect a financial account, you authorize Setsail and its service providers, including Plaid, to access the categories of account information you approve, such as account metadata, balances when authorized, transaction history, merchant information, and categorization data. Setsail does not receive or store your bank login credentials.
Plaid access tokens are encrypted. During the pre-launch period, you may request linked-account disconnect by contacting Everfancy. Where self-service disconnect controls are available in Setsail, you may also use those controls. Disconnecting an account stops new collection from that account, but does not automatically delete information already stored on your device.
AI Features
If you use AI or chat features, prompts, relevant app context, selected financial content, and outputs may be processed by Everfancy and AI service providers to return the response you requested. AI outputs may be incomplete or inaccurate and are not financial, legal, tax, investment, or credit advice. You should review outputs before relying on them.
Subscriptions And Payments
Paid features may require a subscription or other charges. The purchase screen will show the price, billing period, renewal terms, trial or promotional period if any, cancellation method, and refund rules before you subscribe.
Subscriptions renew automatically unless canceled before the renewal date. You authorize us, the applicable app store, or the applicable payment provider to charge recurring fees until cancellation. Cancellation takes effect at the end of the current billing period unless the purchase flow or applicable law says otherwise.
Acceptable Use
You may not misuse Setsail, interfere with the service, attempt to access systems or data without authorization, violate law, or use the service to harm others.
Ownership
Everfancy and its licensors own Setsail, including the software, design, documentation, trademarks, and related intellectual property. Subject to these terms, Everfancy grants you a limited, non-exclusive, non-transferable right to use Setsail for your personal or household use.
Suspension And Termination
You may stop using Setsail at any time. We may suspend or terminate access if you violate these terms, create security or legal risk, fail to pay required charges, or if we discontinue the service or a feature. Sections that by their nature should survive termination will continue to apply.
Third-Party Services
Setsail may depend on third-party services for account connectivity, hosting, authentication, payments, diagnostics, AI processing, and other operations. Those services may have their own terms and policies. Plaid's end user privacy information is available at plaid.com/legal.
App Stores And Devices
If you obtain Setsail through an app store or platform, that store or platform may apply its own terms, payment rules, cancellation tools, refund rules, and device requirements. Those terms are between you and the applicable store or platform.
Availability And Changes
We may change, suspend, or discontinue Setsail or any feature. We aim to operate the service responsibly, but we do not guarantee that it will be uninterrupted or error-free.
Export And Sanctions
You may use Setsail only where legally permitted. You may not use Setsail in violation of export-control, sanctions, or similar laws.
Disclaimers And Limits
Setsail is provided as is and as available to the extent permitted by law. Everfancy LLC is not responsible for decisions you make using Setsail or for losses caused by inaccurate, delayed, unavailable, or incomplete third-party data.
To the maximum extent permitted by law, Everfancy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Everfancy's total liability for claims relating to Setsail will not exceed the greater of the amount you paid for Setsail in the 12 months before the claim or 100 dollars. Nothing in these terms limits rights that cannot be waived under applicable law.
Governing Law And Disputes
These terms are governed by the laws of Washington State, excluding conflict-of-law rules, except where consumer protection laws require otherwise. Before filing a claim, you agree to contact us and try to resolve the dispute informally. Nothing in these terms limits rights that cannot be waived under applicable law.
Changes To These Terms
We may update these terms from time to time. We will provide additional notice for material changes when required by law. Continuing to use Setsail after updated terms take effect means you accept the updated terms.
